TERMS OF USE
The terms of this agreement (“Terms of Use” or “Terms”) govern the relationship between You (hereinafter
“You”) and Circle Games Teknoloji Anonim Şirketi (hereinafter “Circle Games” or “We”) regarding Your use
of Circle Games and related services, including applications for mobile devices. These Terms apply to
all games and applications released by Circle Games and accessible via both www.circle.gs, Apple App
Store and Google Play Store.
1. GENERAL PROVISIONS
1.1. These Terms apply to the use of all games, mobile applications, game portals, forums, chat rooms,
and other game-related services provided by Circle Games on any website, platform, or application store
(collectively referred to as the “Game Services”).
1.2. Your use of any Game Services is governed by these Terms and any additional agreements or terms
applicable to specific services.
1.3. Some Game Services may include features or software provided by Circle Games’ partners, and the use
of such features is subject to separate agreements with those partners.
1.4. The description of certain Game Services may reference these Terms, which means that by using such
services, You agree to these Terms.
1.5. Your use of the Games Services, download to your mobile phone or computer registration of an Extra
Account in the Game Services, the beginning of gameplay in any game, posting a message in the forum/game
chat, as well as downloading any software that is offered for download on the games www.circle.gs
website or on the website of the respective game, is a proof of your unconditional consent to the terms
of the above mentioned documents.
1.6. By registering and download to your mobile phone or computer at the Game Services You confirming
that Your age is sufficient for such registration under the applicable laws and/or You have all
necessary consents (e.g. parental consents) in full compliance with the applicable laws, including for
purposes of data protection laws, otherwise the registration at the Game Services and using them is
prohibited.
2. LIMITED LICENSE
2.1. Circle Games grants You a non-exclusive, non-transferable, and limited license to use the Game
Services for personal, non-commercial purposes.
2.2. From the moment of registration of a Main Account and/or an Extra Account and/or downloading the
certain part of the Game Services, depending on what happened earlier, Circle Games grants You a
non-exclusive, non-transferable to third parties, limited license to use the Game Services, including
all subsequent amendments and improvements (if any) for personal non-commercial purposes by obtaining
access to the published by Circle Games, as well as downloading and installing the client portion of the
Game Services (if any). Subscription is renewed automatically. We are not responsible for the fact that
the player did not turn off the auto-renewal. This license allows You to:
• Participate in gameplay, create characters, purchase in-game currency, and exchange it for in-game
items.
• Install and use the client portion of the Game Services.
• Stream and monetize gameplay videos, as permitted by relevant platforms.
2.3. You are not permitted to:
• Modify, distribute, or decompile the Game Services.
• Translate the Game Services into other languages, or create other derivative works from the Game
Services.
• Try to obtain the in-game currency, and/or in-game valuables fraudulently or in other ways not
provided for by the usual gameplay process and conditions of purchasing the in-game currency and
exchanging in-game currency for in-game valuables.
• Distribute for commercial purposes any element of the Game Services, its copies or screenshots.
• Distribute for commercial or non-commercial purposes the in-game currency and/or in-game valuables
outside the framework of the gameplay process, transfer the right to use the Game Services for
commercial or non-commercial purposes to third parties, including through the transfer of a game
character or a login and password required to access the Main Account and/or Extra Account.
• Use the Game Services in other ways, not provided for by these Terms and beyond the usual gameplay
process.
2.4. All rights not expressly granted to You under these Terms shall be reserved by Circle Games.
3. IN-GAME CURRENCY AND ITEMS
3.1. If You wish, You can purchase proposed in the Game currency (in-game currency), which can be used
by You solely under the conditions specified below.
3.2. All fees payable for in-game currency are non-refundable. Circle Games does not guarantee the
availability or indefinite usability of in-game items.
3.3. The in-game currency, although it has a price at the time of purchase, has no monetary value and is
not subject to monetary evaluation, is not a means of payment, and serves a sole purpose so that You can
exchange it for consumed in-game valuables. The in-game currency cannot be exchanged for cash or other
valuables, except for in-game valuables in the usual course of the game process, even if it was not used
by You while You had the opportunity.
3.4. In-game currency is purchased by You by paying for the appropriate amount of the in-game currency
by one of the payment methods provided for each respective Game Service/on the corresponding website of
the Game Services. The charge of the in-game currency to Your in-game account shall be made as soon as
possible; however, due to circumstances beyond the control of Circle Games, there may be delays in the
provision of payment information systems about Your payments. Please note that Circle Games will not
credit the in-game currency to Your in-game account until Circle Games has received a confirmation of
receipt of Your payment. In case of no crediting of Game currency within 24 hours from the time of
payment, please contact our customer service at contact@circle.gs. The moment of crediting the in-game
currency to Your in-game account shall be considered the moment of transferring the appropriate amount
of the in-game currency to Your in-game account. Circle Games does not guarantee that the purchase
and/or use of in-game currency are lawful in Your jurisdiction.
3.5. You understand and agree that the purchase of the in-game currency and in-game valuables is a
purchase of a limited, non-exclusive, non-transferable license to use such in-game currency and in-game
valuables within the Game Services. This license does not represent a right to own property. All in-game
valuables and in-game currency remain the property of Circle Games.
3.6. Circle Games may, in its sole discretion, restrict, suspend, or terminate Your access to in-game
currency and/or in-game valuables if it believes that You are in violation of these Terms, acting
fraudulently, or otherwise causing harm to the Game Services or other users. In this case, no refund or
compensation will be provided.
4. CODE OF CONDUCT
4.1. While using the Game Services, You agree to adhere to the following rules of conduct. Any violation
of this Code of Conduct may result in temporary or permanent suspension of Your account, removal of
in-game privileges, or other disciplinary actions, as deemed appropriate by Circle Game.
4.1.1. Prohibited Behavior
You agree not to engage in the following activities while using the Game Services:
• Offensive Content and Behavior:
o Post, upload, or share any content that is offensive, discriminatory, hateful, obscene, sexually
explicit, defamatory, or otherwise inappropriate.
o Promote or incite violence, hate speech, or any illegal activities.
o Use slurs, abusive language, or gestures to harass, demean, or threaten others.
• Cheating and Exploitation:
o Use automated tools, bots, cheats, hacks, exploits, or any unauthorized third-party software to gain
an unfair advantage or manipulate the game environment.
o Exploit bugs, glitches, or loopholes in the Game Services for personal gain or to disrupt the gameplay
experience for others.
• Harassment and Threats:
o Harass, threaten, stalk, or bully other users, whether through text, voice, or any other communication
methods provided by the Game Services.
o Impersonate or falsely represent another user, moderator, administrator, or any Circle Games
representative.
• Unauthorized Transactions:
o Engage in the buying, selling, trading, or gifting of in-game currency, valuables, accounts, or items
outside the scope of the Game Services or without Circle Games’s explicit permission.
o Attempt to access or steal another user’s account, payment information, or personal data.
• Disruption of Services:
o Engage in any activity that disrupts, overloads, or interferes with the normal operation of the Game
Services, servers, or networks.
o Deploy denial-of-service (DoS) attacks, distribute viruses, or otherwise harm the Game Services,
Circle Games, or its users.
4.1.2. Respectful Interaction
• Treat all users, administrators, and moderators with respect, dignity, and courtesy.
• Avoid arguments or confrontations that may escalate into personal attacks or disrupt the community
environment.
4.1.3. Compliance with Laws
• Abide by all applicable local, national, and international laws while using the Game Services.
• Do not engage in or promote any illegal activities, including but not limited to fraud, money
laundering, or unauthorized data collection.
4.1.4. Intellectual Property and Content Sharing
• Do not upload, share, or distribute copyrighted, trademarked, or proprietary content without proper
authorization.
• Avoid sharing misleading or false information about the Game Services, its developers, or its users.
4.1.5. Account and Security Responsibilities
• Ensure the confidentiality of Your account credentials and never share them with others.
• Report any unauthorized access or suspicious activity on Your account to Circle Games immediately.
• Do not attempt to access, tamper with, or modify accounts, systems, or data belonging to other users
or Circle Games.
4.2. Reporting Violations
If You encounter or witness a violation of this Code of Conduct, please report it to Circle Games’s
support team at contact@circle.gs or through the in-game reporting system. Circle Games will investigate
all reports and take appropriate action where necessary.
4.3. Enforcement and Penalties
Circle Games reserves the right to enforce this Code of Conduct at its sole discretion. Depending on the
severity of the violation, penalties may include, but are not limited to:
• Warnings or temporary suspension of Your account.
• Permanent ban or deletion of Your account.
• Revocation of in-game currency, items, or privileges.
• Legal action, if necessary, to address severe or illegal activities.
4.4. Updates to the Code of Conduct
Circle Games may update this Code of Conduct at any time to reflect changes in community standards,
applicable laws, or the nature of the Game Services. Continued use of the Game Services after such
updates constitutes Your acceptance of the revised Code of Conduct.
5. ACCOUNT AND SECURITY
5.1. To access Circle Games’ services (“Game Services”), You may be required to create an account (the
“Account”). This Account will include Your login credentials, personal information, and other
preferences necessary to use the Game Services.
5.2. You are responsible for maintaining the confidentiality of Your login credentials and for all
activities that occur under Your Account. If You become aware of any unauthorized access or security
breach, You must notify Circle Games immediately.
5.3. Circle Games reserves the right to suspend, restrict, or terminate Your Account at any time, at its
sole discretion, if You violate these Terms or engage in any prohibited, unauthorized, or illegal
activities.
5.4. You are strictly prohibited from transferring, selling, sharing, or otherwise granting access to
Your Account to any other person without the prior written consent of Circle Games.
6. INTELLECTUAL PROPERTY
6.1. All content, materials, and intellectual property provided through the Game Services—including but
not limited to software, graphics, designs, text, videos, sound recordings, and logos (collectively, the
“Content”)—are owned or licensed by Circle Games and are protected under applicable copyright,
trademark, and other intellectual property laws.
6.2. Circle Games grants You a limited, non-exclusive, and non-transferable license to access and use
the Content for personal, non-commercial purposes only. Any unauthorized use of the Content is strictly
prohibited.
6.3. You may not copy, modify, distribute, display, perform, publish, reverse-engineer, or sell any part
of the Content without prior written authorization from Circle Games.
7. DISCLAIMER OF WARRANTIES
7.1. The Game Services are provided “as is” and “as available,” without warranties of any kind, whether
express or implied, including but not limited to implied warranties of merchantability, fitness for a
particular purpose, and non-infringement.
7.2. Circle Games does not guarantee that the Game Services will be uninterrupted, secure, error-free,
or free from harmful components. Your use of the Game Services is entirely at Your own risk.
8. LIMITATION OF LIABILITY
8.1. To the fullest extent permitted by applicable law, Circle Games shall not be liable for any
indirect, incidental, consequential, punitive, or special damages arising from or related to Your use of
the Game Services. This includes but is not limited to damages for lost profits, loss of data, or other
intangible losses, even if Circle Games has been advised of the possibility of such damages.
8.2. Circle Games’ total liability to You for all claims related to the Game Services shall not exceed
the total amount You have paid to Circle Games for access to the Game Services in the six (6) months
preceding the claim.
9. INDEMNIFICATION
9.1. You agree to indemnify and hold harmless Circle Games, its affiliates, and their officers,
directors, employees, agents, and licensors from and against any claims, damages, liabilities, costs, or
expenses (including reasonable attorney’s fees) arising from:
• Your use of the Game Services;
• Your violation of these Terms or applicable laws;
• Any breach of intellectual property or privacy rights caused by Your actions.
10. TERMINATION
10.1. Circle Games reserves the right to terminate, suspend, or restrict Your access to the Game
Services, with or without notice, if You are found to have violated these Terms or engaged in any
unauthorized or illegal activities.
10.2. Upon termination, all rights granted to You under these Terms shall immediately cease. You must
discontinue use of the Game Services and delete any installed files or components related to the Game
Services from Your devices.
10.3. Any provisions of these Terms intended to survive termination—including but not limited to
intellectual property, limitation of liability, indemnification, and dispute resolution—shall remain in
effect.
11. GOVERNING LAW AND DISPUTE RESOLUTION
11.1. These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in
which Circle Games is registered, without regard to conflicts of law principles.
11.2. Any disputes arising from or related to these Terms or the Game Services will be resolved through
binding arbitration in accordance with the rules of the arbitration center located in Circle Games’
jurisdiction. You and Circle Games agree to submit exclusively to this arbitration process for dispute
resolution.
11.3. Circle Games may seek equitable or injunctive relief in a court of competent jurisdiction to
protect its intellectual property rights or enforce these Terms.
12. MISCELLANEOUS
12.1. These Terms constitute the entire agreement between You and Circle Games regarding Your use of the
Game Services, superseding any prior agreements or communications.
12.2. If any provision of these Terms is deemed invalid, unlawful, or unenforceable, the remaining
provisions will continue in full force and effect.
12.3. Circle Games’ failure to enforce any provision of these Terms does not constitute a waiver of that
provision or any other rights.
12.4. Circle Games reserves the right to modify or update these Terms at any time. Such modifications
will take effect immediately upon being posted. Continued use of the Game Services constitutes Your
acceptance of the updated Terms.
